US Lawmaker says DoD used non-approved vaccines on US soldiers in violation of the department’s own policy that legally requires only FDA-approved vaccines be used
Unless you’ve been paying close attention to the news about the vaccines, it’s almost impossible to know if the vaccines already administered to millions of Americans were actually approved by the US Food and Drug Administration (FDA).
On January 31, the FDA granted full approval to Moderna’s COVID-19 vaccine. The ‘FDA approved’ Spikevax vaccine is not available to people in the US and has not been tested for Omicron. In a widely-celebrated press release on Monday, the FDA said:
“Today, the U.S. Food and Drug Administration approved a second COVID-19 vaccine. The vaccine has been known as the Moderna COVID-19 Vaccine; the approved vaccine will be marketed as Spikevax for the prevention of COVID-19 in individuals 18 years of age and older.”
However, the FDA also noted (page 3) in the small print of its approval letter that Spikevax and Moderna’s emergency use authorization shots are “legally distinct” products, adding that there are “certain differences that do not impact safety or effectiveness.”
On August 23, 2021, the FDA granted full approval to the Pfizer-BioNTech coronavirus vaccine. Unfortunately, the approved FDA vaccine is not the same vaccine currently in use by millions of Americans. The FDA also made the same disclaimer it made for the Moderna vaccine when it approved Pfizer’s Comirnaty, which has never seen the light of day in the United States.
“9 The licensed vaccine has the same formulation as the EUA-authorized vaccine and the products can be used interchangeably to provide the vaccination series without presenting any safety or effectiveness concerns. The products are legally distinct with certain differences that do not impact safety or effectiveness.”
Now according to a US lawmaker, the US Secretary of Defense used the FDA-approved Comirnaty vaccine as the basis for vaccine mandate for US military personnel and their families. In a post on Twitter, US Representative Thomas Massie provided a timeline of the event and accused DoD of using non-approved vaccines on US soldiers in violation of the department’s own policy that legally requires only approved vaccines to be used.
“This is fraudulent: * 8/23/2021 FDA approved Comirnaty vax. * 8/24/2021 SecDef issued a mandate because Comirnaty was approved. * Comirnaty was never produced by Pfizer. * DOD says non-approved vax will be used to satisfy mandate that legally required an approved vax,” Massie tweeted.

In a subsequent tweet, Representative Massie also shared an image of a letter from DoD that shows only approved vaccines should be used. Representative Massie tweeted:
