Click to Cancel: FTC unveils ‘Click to Cancel’ rule to simplify subscription cancellations and protect consumers
The revisions, effective in 60 to 180 days, require companies to provide clear information about subscription terms, obtain explicit customer consent before charging, and offer a straightforward cancellation process, known as “Click to Cancel.”
The new rule concludes a multi-year effort that started in 2019, incorporating feedback from thousands of public comments from consumers, industry experts, law enforcement, and others. The full details can be found in the Federal Register Notice.
The rule applies to nearly all subscription programs, including business-to-business deals, and prohibits material misrepresentations. Companies must also maintain proof of consent for at least three years. Failure to comply can result in civil penalties. Businesses are encouraged to review their practices to ensure compliance with both FTC regulations and any relevant state laws.
